Welcome to My Thrift Baby Loot, owned and operated by Kiasha's MTL Private Limited ("Company", "we", "us", "our"). By accessing, browsing, purchasing from, selling on, or otherwise using mythriftbabyloot.com ("Website" / "Platform"), you agree to be bound by these Terms & Conditions ("Terms"), along with our Privacy Policy, Shipping & Logistics Policy, Return Policy, and Seller Guidelines, which are incorporated herein by reference.

If you do not agree to these Terms, please refrain from using the Platform.

My Thrift Baby Loot is a parent-first, community-driven marketplace that facilitates transactions between independent sellers ("Sellers") and buyers ("Buyers") for pre-loved, used, or new children's products ("Products").

Products are shipped or handed over directly from individual sellers' homes and not from centralised warehouses. The Company acts solely as a facilitator and mediator and does not manufacture, store, inspect, or own the Products unless explicitly stated.

The Company reserves the right to modify, add, suspend, or discontinue any service or feature at its discretion.

By using the Platform, you confirm that:

• You are legally competent to enter into a binding agreement
• You will provide accurate, complete, and current information
• You will not use the Platform for illegal, abusive, fraudulent, or unauthorised purposes

Any misuse may result in suspension or termination of access without prior notice.

Sellers are responsible for ensuring the accuracy of product descriptions, images, condition details, and pricing. The Company does not independently verify every listing.

In rare cases, a product may become unavailable after an order is placed due to seller constraints, accidental damage, loss, or inventory discrepancies arising from home-based storage. In such cases, the Company may cancel the order and issue a refund. Such cancellations shall not be considered a breach of trust or service.

The Company reserves the right to list, de-list, amend, modify, or remove any listing at its discretion.

Most Products listed on the Platform are pre-owned. Minor wear and tear, sizing variations, and slight colour differences are inherent and must be accepted in good faith.

Buyers are encouraged to carefully review product details and images before placing an order.

We reserve the right to add approximate shipping charges and collect taxes for shipping charges wherever applicable which are subject to change as per third party terms. All matters related to dispatch timelines, delivery timelines, courier responsibility, transit risks, pickup failures, RTO charges, and self-pickup are governed by our Shipping & Logistics Policy.

Buyers acknowledge that:

• Products are shipped from individual homes
• Courier partners are independent third parties
• Delivery timelines are indicative and not guaranteed

Returns, refunds, defect claims, cancellations, quality checks, and acceptance conditions are governed strictly by our Return Policy.

Orders once placed cannot be cancelled by the Buyer except as expressly permitted under the applicable policy.

Wherever applicable, refunds are preferably issued as store credits or vouchers. Buyers may request a monetary refund, which will be processed as per the applicable timelines.

Prices are subject to change without notice and are not guaranteed to be the lowest across platforms.

Shipping charges, applicable taxes, and customs duties (for international deliveries) shall be borne by the Buyer and may vary based on third-party logistics providers.

All payments are processed through secure third-party payment gateways. The Company does not store full card details and shall not be liable for gateway failures or unauthorised transactions beyond its control.

In the event of delivery failures due to incorrect or incomplete address details, Buyer unavailability, refusal to accept delivery, or failure to respond to courier partners, the shipment may be returned to origin (RTO).

All RTO charges, re-shipment costs, and additional logistics fees arising from such failures shall be borne entirely by the Buyer.

For self-pickup or buyer-arranged courier orders:

• Buyers must inspect the Product at the time of pickup
• Transit risks lie entirely with the Buyer-appointed logistics provider
• No return or refund claims will be accepted for transit-related damage

We strongly discourage Sellers from uploading photographs showing children or minors wearing Products.

If such images are uploaded, the Seller confirms that they are the parent or legal guardian of the child and have full authority and consent to share such images. The Seller accepts full responsibility for any misuse, unauthorized sharing, or third-party exploitation of such images.

The Company shall not be responsible for misuse of personal or child-related images once uploaded. We reserve the right to remove, blur, or reject such content at our discretion.

Sellers must ensure that all images, videos, and descriptions uploaded are either:

• Original content created by them, or
• Content they are lawfully authorized to use

Uploading screenshots or content copied from brand websites or other marketplaces without permission may infringe intellectual property rights.

The Company shall not be liable for copyright infringement arising from user-submitted content. Sellers agree to indemnify the Company against any claims arising from such violations.

The Company may participate in affiliate programs, including but not limited to Amazon, FirstCry, and other marketplaces. Certain links shared on the Website, social media, emails, or videos may be affiliate links, and the Company may earn a commission or monetary benefit at no additional cost to the user.

Product recommendations are shared for informational and convenience purposes only and do not constitute endorsements, guarantees, or warranties.

The Company does not control pricing, availability, delivery, returns, or customer service of third-party marketplaces. All such transactions are governed by the respective platform's terms.

The Company may publish product-related videos on platforms such as YouTube and social media. Such content may include affiliate links, sponsored mentions, or platform-based monetisation.

Any monetary benefit earned does not influence the integrity of the content. Views expressed are informational and should not be treated as professional or purchasing advice.

The Platform may contain links to third-party websites or services. The Company does not control and is not responsible for their content, policies, or practices. Any disputes must be addressed directly with the respective third party.

All Products and Services are provided on an "as-is" and "as-available" basis. The Company makes no warranties regarding uninterrupted service, accuracy, or reliability.

To the maximum extent permitted by law, the Company shall not be liable for indirect, incidental, or consequential damages arising from Platform use.

The Company shall not be liable for delays or failures caused by events beyond reasonable control, including natural disasters, strikes, system failures, government actions, or logistics disruptions.

The Company may update these Terms at any time. Continued use of the Platform constitutes acceptance of the revised Terms.

If any provision is held unenforceable, the remaining provisions shall remain valid and enforceable.

These Terms shall be governed by the laws of India. Courts at Mumbai, India shall have exclusive jurisdiction over any disputes arising from these Terms.
